Civil Law

Civil law is one of the main areas of the law in which other segments of the law are regulated and formulated. Whilst the list of areas of Civil Law is vast, one may refer to some main traditional subjects as regulated by the Civil Code, which include Contractual Obligations, the Law of Persons and of Things. Other areas of Civil Law are generally regulated by means of a separate chapters of law, which are further regulated by means of subsidiary legislation.

Any civil dispute is regulated by the Code of Organisation and Civil Procedure, where the latter provides for the manner how a dispute can be tackled between the relative parties both before the matter is referred to the Courts of Malta, and even after. It is to be noted that, Civil Procedure is deemed to be equally important to Civil Law itself and this owing to the fact that no claim may be deemed rightful unless the proper and correct procedure is followed.
