Constitutional Law

Constitutional Law regulates amongst others principles and fundamental human rights and freedoms of the Individuals. The Constitution of Malta is the supreme law of the Maltese Islands and therefore it sets out principles for the formulation of other laws adopted into Maltese Law. Furthermore, other legal instruments which recognises one’s fundamental rights and freedoms of the individual include the European Convention for the Protection of Human Rights and Fundamental Freedoms and the European Charter of Human Rights.

As a matter of fact, constitutional cases may be instituted in order to obtain a declaration that a particular article of the law or circumstance has breached one’s fundamental rights and freedoms in terms of the Constitution of Malta and/or the European Convention for the Protection of Human Rights and Fundamental Freedoms. Examples of fundamental human rights include, the right to a fair hearing, the right to property, the freedom of expression and from discrimination on the grounds of age, sexual orientation, gender identity, race or ethnic origin, belief and religion and sex.

Constitutional Law can be easily deemed as the expression of a democratic state and the mother of all laws.
